On Tuesday (21), Elvis Zepeda was arrested after shooting the driver who ran over and killed his 2-year-old son, Benjamin, in Stanislaus County, California. The father was charged with attempted murder and illegal possession of a firearm, according to KMPH.

According to the California Highway Patrol, Elvis Zepeda and his son were on the shoulder of the highway near a food truck when Benjamin ran into the roadway.

The father tried to chase after the child, who was struck by a BMW. The 19-year-old driver stopped his car to assist Benjamin. At that moment, Elvis fired a gun at the back of the vehicle.

The child was taken to the hospital but did not survive his injuries.

The driver fled the scene but later called the Highway Patrol to assist with the investigation. He was not injured by the gunshots.

According to KTXL, authorities found no evidence that the driver had been driving recklessly.

Benjamin Zepeda was described by his mother, Almendra Alfaro, as a very loving boy. “He loved watching Spider-Man, drinking juice boxes, and hiding apple sauce pouches in his room,” Alfaro told CBS News.
