According to the lawsuit, the plane was traveling from Logan International Airport to JFK Airport in New York.
The cart “forcefully hit [Sim]’s right foot, crushing it against the left armrest of the seat in front of him.” The lawsuit also states that the cart hit other passengers before it “overturned and stopped.”
The passenger reported suffering multiple injuries, including “several debilitating crush fractures and a deep wound that required months of intensive medical treatment.”
Dalton Sim is seeking an unspecified amount in damages.
“We are privileged to pursue justice on behalf of Mr. Sim for the life-changing injuries he suffered in a completely avoidable incident caused by the outrageous and inexcusable negligence of Republic Airways staff,” said attorney Erin Applebaum.
Republic Airways has not commented on the case.
